The Company Service connects health care facilities, medical groups and hospitals, and their representative coordinators and administrators (herein together “coordinators” or “Healthcare Organizations”) with Healthcare Providers (together with coordinators, “users” or “you”). Modio regards all coordinators, while using Modio Service, as representative agents of the entities for which they work. By visiting and/or using the Company Service, you signify that you have read, understand and agree to be bound by these Terms of Service (herein also referred to as “Agreement”). We reserve the right to modify these terms or any additional terms that applies to a Service, reflect changes in the law or changes to our Service. Modio Health only collects personal identifying information from you on a voluntary basis, which is uploaded at the time you register with Modio and build a user profile. Modio Health is committed to maintaining the confidentiality of the personal identifying information that the Company solicits.
So that we can provide you with the most efficient and enhanced experience, we request that you register for a personal account accessible through a confidential password and screen name that you select. For purposes of registration, we collect identifiable information about you such as your name, email address, and demographic information such as age, gender and zip code. Doctors are able to submit their invoices for work performed onto the Company Platform and Website so that they may be processed. We also may collect your IP address, browser type, operating system type, domain name, access times and referring website address. This information is collected during registration or in response to specific requests from you, for things such as signing up for an email newsletter or other online information service we may offer, answering a survey, or contacting us. Surveys are conducted strictly for internal profiling purposes and only keep track of anonymous demographic data (e.g., your age, usage of the Modio Health website, favorite features). Our website contains links through which an online user can email us. We collect personal information contained in the email for the purpose of responding to a user's questions and/or comments.
Currently, Modio receives User social security numbers in an encrypted format so that the actual number is unknown to Modio during the regular course of business. However, in the future, in order to accommodate changes to Modio's payment structure, as well as to facilitate User requests of Modio to renew User DEA licenses on their behalf, Modio may request social security numbers, which must be fully visible to the Company and any third parties that require the data to fulfill license renewal procedures. Users will voluntarily elect to have Modio perform the renewal on the Users' behalf, so such disclosure of visible social security number is entirely voluntary. At such time as visible social security numbers are required, and before submission by the User, Modio will make the User aware that the information they are about to provide will be visible to the Company. At all times, Modio takes all reasonable measures to protect and maintain the security of content uploaded by Users (as defined in the Company Terms of Service), including social security numbers. However, Modio takes no responsibility for the protection measures of third parties with whom Modio deals. Users agree to waive Modio's responsibility for the treatment of content uploaded by User by such third parties.
Modio Health uses the data it collects to match doctors with hospitals. Specifically, if the doctor accepts the connection, then Modio Health will submit the doctor's information to the hospital so as to facilitate the best relationship possible between the matched parties. When a doctor lists his/her profile as “Active,” his/her user profile will become searchable by hospitals, medical groups and medical facilities and their representatives who subscribe to Modio Health's services. Modio Health also uses the data it collects to match doctors to other partner opportunities, such as finance partners and education partners. Again, if there is a match, Modio Health will submit the doctor's information to the partner so as to facilitate the best relationship possible between the matched parties.
Additionally, Modio Health uses the data it collects to perform background checks on its participants in order to ensure that the highest quality professionals participate on Modio Health's platform. Modio Health uses the data it collects for re-marketing purposes via email, and for important notifications and alerts to its users via email and SMS text message. Modio Health may send you alerts, invitations, reminders, notifications, promotions, and other messages by email to the email address you provided at the time of registration. At any time, you may disable (or “unsubscribe”) this email notification function within your User Settings.
Modio Health also collects and integrates data from third-party providers through licensing agreements. These third-party providers provide data on healthcare facilities of interest to the Users of the Modio Health Service. Third-party providers that generate data for the Company include the DEA, the state(s) in which the Company operates, ARDMS for certification data, and other government agencies. This data is made available to Users, including Coordinators, for use at their discretion, including alteration of the data to fit particular user needs. Modio Health makes no claims regarding the accuracy of the data it collects through third-party providers. Modio Health acts merely as a passive sharer of the data uploaded to the Service. Again, User hereby releases Modio Health from all liability whatsoever for damages of any kind resulting from the misuse of the data, and any other content, posted by Users on the Modio Service. Modio Health has no control whatsoever over the use by users of content uploaded to its Service by Users. Modio Health does not condone the misuse of data, or any other content, uploaded to its Service.
No matter what method we use to collect information and no matter how we use that information, we will only collect the information deemed reasonably necessary to fulfill your online requests and our legitimate business objectives.
Modio Health may generate and store aggregations of data from large pools of users. Such aggregation does not contain personally identifiable information.Modio Health uses this aggregate data to generate useful, comparative analytics and thereby improve Company services. We may publish the analytics publicly, and share them with the users of Company services. Further, Modio Health reserves the right to target users using this aggregate data for purposes of advertisement within the Company platform. By using Company services, you agree to the collection, usage and storing of aggregate data.

How Does Modio Health Respond to Data Breaches

Modio Health uses Amazon Web Services (“AWS”) to store the data it collects. Modio Health leverage AWS security features and best practices to design a secure environment. Modio Health encrypts personal and business data in the AWS cloud, and publishes backup and redundancy procedures for services so we can protect the data collected and keep the platform running. Modio Health does not own or operate AWS. Modio Health does not make any representations whatsoever regarding AWS practices or procedures. Accordingly, Modio Health is not responsible whatsoever for the practices of AWS, or for any damages whatsoever to Users arising from AWS practices. Users are encouraged to familiarize themselves with AWS practices and procedures.
The Internet is not a 100% secure medium. Although we use reasonable efforts to protect information, the potential of somebody breaching our security measures does exist.
